These Terms and Conditions (the “Terms”) refer to your use of the smartscripts.today website, (the “Site”). Please read these Terms carefully before using this Site as they set out your rights and obligations with respect of the use of the Site and the Service (as defined below). Our Privacy Policy is incorporated by reference into these T&Cs. By using our site, you confirm that you accept these Terms and that you agree to comply with them. If you do not agree to these Terms, please do not use our Site. By using the Site and or the Service offered on the Site you (the “User”) are deemed to warrant that you are seventeen years of age and over.
Introduction
The Site is owned and operated by Healthcare Now Ltd . We are registered in Ireland under company registration number 664253 with a registered address at Inniscarra House, Rathcoole, Co Dublin. To contact us, please email info@smartscripts.today. For users agreeing to and accepting the T&Cs within the questionnaire at the end of the online consultation constitutes consent and acceptance of these T&Cs.
User modification of the terms of service
We reserve the right to modify these Terms at any time and at our sole discretion and without notice to you. By continuing the use of the Service, the user agrees to be bound by the amended terms and conditions of use.
Scope of these terms and conditions of use
As a consumer, nothing in these terms affect your statutory rights.
The Site Services are directed solely at those who can access this Site from the Republic of Ireland. No representation about the Service referred to on this website is appropriate for use or available in other locations outside the Republic of Ireland. Those who choose to access this Site from other countries are responsible for compliance with Applicable Laws if and to the extent local laws are applicable.
Responsibility of our doctors for their patients
Our doctors take exactly the same personal responsibility for each patient as they would if they were seeing a patient face to face. Neither the online nature of this service nor the existence of Healthcare Now T/A smartScripts as the legal entity behind the service seeks to diminish the professional obligations that our doctors owe to a patient.
The importance of providing true, timely and complete information
You agree that all information that you provide to our doctors will be true and complete to the best of your knowledge and that you will not purposefully omit to provide information that could reasonably be judged to be potentially relevant to our doctors in providing the service. You should not complete questionnaires on behalf of anyone other than yourself.
Scope of services provided
This service is provided to residents of the Republic of Ireland only. Our doctors provide medical services for specific medical conditions.
Our doctors may offer medical advice through our GP phone consultation service, if deemed safe and appropriate prescriptions may be prepared for medical conditions other that the specific services we provide.
Prescriptions written by our doctors
You agree that any medicine our doctors prescribe will be solely for your own personal use and that you will not allow any other person to take the medicine.
If our doctors have issued a prescription for a medicine within a service that offers in-pharmacy collection, this will be sent electronically directly to your nominated pharmacy.
You agree that before taking any medicine that our doctors have prescribed you will read all the information that the doctor has provided you with both online and in printed form, you will read the manufacturer’s Patient Information Leaflet that accompanies the medicine and you will follow any advice that the dispensing pharmacist provides you with. If the advice that the dispensing pharmacist provides you with contradicts the advice provided by our doctors, you agree that you will contact us for further advice before taking the medicine.
You agree that if our doctors prescribe a medicine and you suffer from any noticeable side-effects, you will contact us to allow our doctors to fulfil their duty of after-care and to allow them to monitor the effectiveness of all medicines that they pr.
Informing your existing doctor about any treatment that is prescribed
Our doctors will always encourage you to let us inform your existing doctor, you can select this option at the end of the consultation. It is our recommendation you inform your primary care GP of any medications prescribed to you, but this is your choice and we respect that.
Privacy Policy
smartScripts protects your personal information and only processes it for specific reasons. You have certain rights in relation to your personal information. Our https://www.smartscripts.today/privacy-policy/ sets out our legal obligations, your rights, and other important information relating to your personal information. We ask you to agree to our Privacy Policy before you use our services.
Data protection
All information received by us from your use of this Site will be used in accordance with our Privacy Policy.
Sensitive personal information
Any information provided as part of the online or telephone consultation or follow up by telephone or email consultation becomes part of your Electronic Health Record. You agree to periodically update your information and to provide complete and accurate information about yourself.
The Republic of Ireland Medical Council, Guide to Professional Conduct and Ethics for Registered Medical Practitioners, 8th Edition 2016, principles-based guidance is to share your doctor consultation with your IMC registered General Practitioner (“GP”).
How we use your personal information (Data Protection)
All personal information that Healthcare Now T/A smartScripts may collect (including sensitive personal information) will be collected, used and held in accordance with the provisions of the Republic of Ireland and European Law and your rights under that legislation and the accompanying regulations and guidance.
We may use your personal information to:
- Provide Our services to you;
- Process your Order (including payment) for the Products and Services.
- Inform you of new products and/or services available (if you opt in or have previously opted in to receive it). You may request that we stop sending you this information at any time; and
- Our Privacy Policy which form part of these Terms and Conditions will not pass on your personal information to any third parties without first obtaining your express consent.
Healthcare Now T/A smartScripts use the following products to deliver the service to you;

with a service. These include all the companies and services listed:

In line with the Data Protection Acts, you have the right of access to any personal information about you and can request this information from smartScripts at any time.
Obligations and responsibilities of Healthcare Now T/A smartScripts
Healthcare Now T/A smartScripts puts in place the means and measures necessary for the smooth running and maintenance of the continuity and quality of the Services.
The User acknowledges that smartScripts’s role is limited to that of a technical service provider.
The User acknowledges that smartScripts cannot be held responsible for an interruption of services or a delay in execution that is beyond their control and, in particular, that the provision of the Services depends on the reliability, availability and the continuity of connections of a number of third parties (telecommunications network operators, the public Internet, User Equipment, etc.) as well as the accuracy and integrity of User Data.
It is understood between the Parties that smartScripts can in no way be held responsible for repairing any indirect damage suffered by Users during the use of the Services.
In addition, smartScripts cannot be held liable for acts (i) resulting from an act or negligence of the User or (ii) and which do not comply with the applicable regulations and / or the Contract. smartScripts declines all responsibility in the event of a dispute, whatever the cause, between a User and a Healthcare Provider providing services to Healthcare Now , not attributable to smartScripts.
smartScripts can in no way be held responsible (i) for the non-performance or improper performance of an act or treatment by a Healthcare Provider (ii) for the content of a Prescription or a Medical Document and / or (iii) side effects experienced by a User.
Refunds
smartScripts offers a full refund on requests that do not result in a prescription being issued. If a prescription has been issued and a refund is requested we will not be able to issue a full refund, depending on the treatment and situation a partial refund of 50% of the consultation fee can be processed.
Refunds for GP phone Consultation Service
If it’s obvious to the doctor that he/she is unable to help we will provide a full refund. When a doctor proceeds to have a phone consultation with the patient a refund will not be provided.
Disclaimer
To the fullest extent permitted by applicable law, under no circumstances will Healthcare Now T/A smartScripts or our doctors be liable for any of the following losses or damage (whether such losses were foreseen, foreseeable, known or otherwise):
- loss of emotional well-being including, but not limited to, any embarrassment caused
- loss of data outside of our legal obligations
- loss of goodwill or injury to reputation
- losses suffered by third parties
- any indirect, consequential, special or exemplary damages arising from the use of the smartScripts service regardless of the form of action.
Nothing in this clause is intended to exclude or limit Healthcare Now’s liability for death or personal injury caused by its negligence or fraud.
You agree that to the fullest extent permitted by applicable law, Healthcare Now T/A smartScripts makes no representations or warranties with respect to any treatment, information, advice or action relied on or followed by any person using the service.
To the fullest extent permitted by applicable law, Healthcare Now T/A smartScripts disclaims any liability resulting from the provision of services by third party providers. Liability shall rest with the appropriate third party provider and shall not under any circumstance be deemed to rest with Healthcare Now T/A smartScripts.
Miscellaneous
We shall not be liable to you as a result of any failure or delay to perform our obligations under these terms even to the extent that such delay or failure is caused by a force majeure event.
Any waiver (expressed or implied) by either party of any breach of these terms shall not constitute a waiver of any other or subsequent breach. No provision of these terms will be waived by any act, omission or knowledge of the party or its agents or employees except by an instrument in writing expressly waiving such provision and signed by a duly authorised officer of the waiving party. In particular but without prejudice our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing.
Notice to be given pursuant to these Terms to be in writing and it should be delivered by e-mail. Notice should be sent to info@smartscripts.today Notices to the User shall be sent to the e-mail provided by the User.
You may not assign or otherwise transfer your rights or obligations pursuant to these terms.
If any provision of these Terms is deemed to be or becomes invalid, legal void or unenforceable under applicable laws, such provision will be deemed amended to conform to Applicable Laws so as to be valid and enforceable, or if it cannot be so amended without materially altering the intention of the parties, it will be deleted, but the validity, legality and enforceability of the remaining provisions of these Terms shall not be impaired or affected in any way.
These terms shall be construed in accordance with the laws of the Republic of Ireland and shall be subject to the exclusive jurisdiction of the Courts of the Republic of Ireland.
Complaints and feedback
smartScripts always welcome feedback from users and, whilst we always use all reasonable endeavor to ensure that your experience as a user is a positive one, we nevertheless want to hear from you if you have any cause for complaint.
All complaints are handled in accordance with our complaints handling policy and procedure, available from us on request.
